1. Introduction

Welcome to Brutal Kick ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our SMS subscription service available at brutalkick.com (the "Service"). By subscribing, you agree to these Terms in full. If you do not agree, do not subscribe.

We reserve the right to update these Terms at any time. We will notify you of material changes via SMS or email. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old to use this Service. By subscribing, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms. This Service is intended for adults who voluntarily seek tough-love motivational content.

3. Description of the Service

Brutal Kick is an SMS-based motivational subscription service. Once subscribed, you will receive one (1) SMS message per day at your chosen delivery time and timezone, in your chosen language and tone level (Soft, Medium, or Hard).

Brutal Kick is NOT a healthcare, therapy, or mental health service. Nothing in our messages constitutes medical advice, psychological treatment, or professional guidance. If you are experiencing depression, anxiety, an eating disorder, or any other mental health condition, please seek professional support. Do not use this Service as a substitute for professional help.

This Service is designed for mentally healthy adults who want a direct, no-nonsense motivational nudge. It is explicitly not suitable for people currently experiencing:

By subscribing to the Hard tone level, you explicitly acknowledge and consent to receiving messages that contain adult language including profanity and strong language. You confirm that:

Even Soft and Medium tier messages are designed to be direct, blunt, and sometimes sarcastic. If you are sensitive to direct feedback, this Service may not be suitable for you.

6. SMS, Message Frequency, and Carrier Charges

By subscribing, you consent to receive recurring automated SMS messages from Brutal Kick. You will receive one (1) SMS message per day. Standard message and data rates from your mobile carrier may apply. Brutal Kick is not responsible for any charges your carrier may impose.

You may opt out at any time by replying STOP to any message. After opting out, you will receive one final confirmation SMS and no further messages will be sent. You may re-subscribe at brutalkick.com.

7. Opt-In and Opt-Out

Opt-in: You opt in by completing the subscription form at brutalkick.com and completing payment through PayPal.

Upon opting out via STOP, messages stop immediately. Replying STOP does not cancel your PayPal subscription or generate a refund — you must cancel through PayPal to stop future charges. No refund is provided for the current or any prior billing period.

8. Subscription, Billing and Refund Policy

The Service costs $1.99 USD per month, billed through PayPal Subscriptions. Billing is recurring and automatic. Your subscription renews every 30 days unless you cancel before the renewal date.

All charges are in USD. You are responsible for any currency conversion fees charged by your bank or PayPal.

No-refund policy — please read carefully.
All subscription fees are strictly non-refundable once a billing cycle has been charged. By subscribing, you explicitly acknowledge and accept this policy.

How cancellation works: If you cancel your subscription (via PayPal or by replying STOP), no further charges will be made after the current billing period ends. However, the fee already charged for the current cycle will not be refunded — you will continue to receive messages until the end of that paid period.

Example: If you are charged on the 1st of the month and cancel on the 5th, you will not be refunded for that month. Your subscription ends on the 1st of the following month and no further charges will occur.

We do not offer partial refunds, pro-rata refunds, or exceptions to this policy under any circumstances.

Also note: replying STOP to any message stops future messages immediately but does not cancel your PayPal subscription or entitle you to a refund. To stop future charges, you must also cancel through your PayPal account.

We reserve the right to change pricing. Any price changes will be communicated to you at least 14 days in advance via email or SMS.

9. No Guarantees of Results

Brutal Kick makes no representations, warranties, or guarantees that use of the Service will result in any particular outcome, including but not limited to weight loss, improved fitness, increased productivity, or behavioural change. Results, if any, will vary from person to person. The Service is provided as-is for motivational entertainment purposes only.

All content delivered through the Service, including but not limited to SMS message text, website copy, design, and branding, is the intellectual property of Brutal Kick. You may not reproduce, distribute, or create derivative works from our content without express written permission.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Brutal Kick and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 30 days prior to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Brutal Kick and its operators from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your use of the Service or violation of these Terms.

14. Changes to the Service and Terms

We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice. We also reserve the right to update these Terms at any time. Material changes will be communicated via SMS or email at least 7 days in advance.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.

16. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the competent courts of the Republic of Serbia.

If you are a consumer in the European Union or United Kingdom, you may also have access to alternative dispute resolution mechanisms under applicable consumer protection law.
